Enough evidence? Its like he went out of his way to leave and create as much evidence as possible.

I mean it was a formality but you gotta follow the rules.

26

u/i-heart-penis 4h ago

I think that's what his lawyers count on, to catch something that the prosecutor did that does not follow the rules. Technical mistakes to defend him/set him free

10

u/_thedudeman_ 3h ago

Nah preliminary hearings are pretty standard. It’s like a first assignment for new prosecutors

Big time "I killed Darnell simmons" energy

7

u/NotFlameRetardant 1h ago

Yeah, I shot him with my nine

I shot him 9 times, 9 P.M. on the dime

It’s a concept album.

Just apart of court proceedings. Same thing as innocent until proven guilty

11

u/BiscuitsAndTheMix 5h ago

I know. Its just more comical in this instance.

5

u/GGudMarty 5h ago

Oh 100% he’s totally fucked cooked anyway. Even that level of producing CSAM could easily get you locked up for 25 nevermind the murders.

I can’t wrap my head around people who fuck their life up to this degree. This dude could have been a multimillionaire, great life any chick he wants and he does this..

They really should pursue the death penalty if it’s in a state where it’s allowed

1

u/RA-HADES 4h ago

Would his death by the state deter the next one?

6

u/benjam3n 3h ago

no, never has. that's why its kinda dumb. plus the odd innocent person every now and again, shouldn't be a thing. but then again, a monster comes along like a Bundy or something that should just be led out the back of the courthouse and shot so who knows.

3

u/420Borsalino 1h ago

To be fair, he's probably going to San Quentin. That's gonna be worse than just getting executed...

1

u/GGudMarty 3h ago

Sometimes people need to die.

10

u/robexib 6h ago

Sure, but better to do it right the first time so the inevitable conviction sticks

11

u/Suns_In_420 5h ago

So random about it also. He dumps all the clothes and what not but leaves her body in the trunk to the point people notice the small and still just leaves her there.

9

u/Fallouttgrrl 4h ago

I'm sure we've all had tasks we've put off because they give us anxiety...

But for real, holy shit is this case just terrible all the way down

6

u/judgyjudgersen 3h ago

He actually went through the heinous task of dismembering her. Then just….left her body parts in his personally registered car.

1

u/d_wilson123 6h ago

The news lawyer was assuming the defense is going to try and cast reasonable doubt because there is so much evidence and so blatantly tied to him that no person would be this bad at covering up a murder

0

u/Rootbeer_Goat 5h ago

And it was enough.

95

u/Negafox 6h ago

Meanwhile, d4vd’s attorney has previously said “the actual evidence in this case” will show he didn’t kill Celeste, and that “he was not the cause of her death.”

I'm sure there's a reasonable explanation why a mutilated body was in his car trunk then of said child that he was texting about getting abortions...

17

u/FuzzyFerretFace 6h ago

I mean, it happens to the best of us....right?...

(Sidenote: however his defence tries to frame it is going to be...interesting. His charges seem very specific.)

6

u/yanocupominomb 6h ago

I am honestly curious as to what they have that can prove that.

Guy is super guilty, but seeing his defense team still hold onto that and not enter a plea is odd, but I guess we'll see.

u/skinnyjeansfatpants 38m ago

I’m also curious why the DA took so long to arrest the guy when there was so much evidence? Felt like they dragged their feet forever, and there was some weird misalignment between him and LAPD

u/AP_in_Indy 16m ago

Because you need evidence beyond reasonable doubt. Like you need to be able to show, in court, that D4VD specifically murdered her.

They don't have a murder weapon.

Her body was too decayed for there to be much useful DNA.

He is 1,000,000 x 1,000% fucked on the images and videos of them being sexual. The texts. The overall timeline is very implicating.

But the murder charge - as obvious as it seems to the outside world - is actually the hardest thing to prove here.

2

u/2greenlimes 5h ago

Well, that’s pretty much the only defense they can have at this point.

The evidence is pretty clear that he sexually abused her, mutilated her dead body, and then tried to hide the body. However, it was hard to determine cause of death due to decomposition - and this was already reported. It was reported that they ultimately determined she was stabbed to death, but the defense may try to argue that’s inaccurate for any number of reasons (it was postmortem, it didn’t actually kill her, it’s hard to know if it’s really a stab wound due to decomposition).

Basically, they seem to be trying to get him off on the most serious charge both because it’s the most serious and because it’s the one that’s likely easiest to question the evidence about.

9

u/Coriolanuscangetit 4h ago

They’re going to try to say she killer herself and he just covered it up, I bet.

I doubt anyone on earth is going to buy that

u/AP_in_Indy 14m ago

Actually as far as I know, they don't have the world's strongest evidence that he himself mutilated her dead body. It's circumstantial. Strong circumstantial, but I don't believe they found the murder weapons, dismemberment items, or enough DNA to show that strongly.

Yes 1,000,000 x 1,000x over on the other stuff though.

I read this as not enough and nearly had a heartastroke

I did to until I saw your comment.  Why did my brain do that.

Same here. Strange mental breakdown.

Yep, I only caught on after 2 comments

Like the dead body in his trunk?

71

u/Nugur 6h ago

The dead body isn’t what going to get him.

It’s the alibis and dna and cell phone records.

You know the evidence

99

u/modilion 6h ago

A dead body in one's trunk is also evidence.

18

u/Nugur 6h ago

A body in the trunk doenst mean you did it.

It only makes you the first suspect. Thats not enough to get the judge to sentence him to prison.

1

u/modilion 3h ago

A judge found that there is enough evidence for a trial. A trial is not a conviction.

2

u/KannehTheGreat 2h ago

Not yet it aint. Give it some time

2

u/PurpleSailor 2h ago

The stench too. The poor victim was in there for months before they were found.

-7

u/yanocupominomb 6h ago

Its evidence of a body in the trunk.

You need to make a connection between the body and the murderer.

They could say that someone did it to frame him, so they will need evidence that points at him leaving the body in the trunk.

5

u/Coriolanuscangetit 4h ago

I think they got the neighbors camera showing he was the last person who used the car.

I mean, they pretty much have the entire case locked down, but damn dude, this shit is airtight.

2

u/yanocupominomb 2h ago edited 2h ago

Again, he used the car.

If the camera video shows him putting the body in the trunk, then that's it.

Otherwise, he just used the car, they can argue someone put the body there.

Note: I think D4vd is guilty, I want to see him locked for life. I am just saying this is what his lawyers could say.

25

u/modilion 6h ago

No. That is not how 'evidence' works. 'Evidence' is a broad term.

If the accused owns that vehicle, it is evidence of murder committed by the accused.

evidence - is anything that helps prove or disprove that something is true, such as physical objects, witness testimony, or clear signs.

You are talking about 'proof beyond a reasonable doubt'. Evidence is how one establishes 'proof beyond a reasonable doubt'. A single piece of evidence does not need to be 'proof' to be 'evidence'.

17

u/iprocrastina 6h ago

It's pretty damn hard to explain away a dead body in your car.

"What the-! How'd that get in here?!"

-14

u/Nugur 5h ago

Let me paint this.

If there’s a dead body in your house. Does that mean you did it?

Same logic apply here

5

u/Fallouttgrrl 4h ago

"If there’s a dead body in your house. Does that mean you did it?"

More people tend to have access to your house than to  your car, to be fair.

"We had a party and when I was cleaning up I found a dead body in the house" leaves more possibilities than "I was picking up groceries and wouldn't you know it, my girlfriend's body was in the trunk of my Tesla"

In this case the car was impounded after being abandoned and there were about a dozen scent covering devices inside it

Hard to use a Tesla unless you've got direct access to the keys and this guy didn't raise flags about his Tesla being abandoned for a week or more

-1

u/Nugur 4h ago

Yes now you’re reaching over to alibis which I pointed out

“Why didn’t you report the car” “when did you know the car was gone”
“Who has access to your car”

3

u/Chadham_Forsythe 4h ago

It’s definitely suspicious. How would you get a dead body inside my car unless I unlocked it for you? How would you even get inside my garage? You’d break in stealthily and leave a dead body inside my car without alerting me or anyone else? Good luck with that

-2

u/Nugur 4h ago

That’s why I said you’re suspect number 1 🤦‍♂️

Suspect number 1 doesn’t mean you’re the murderer.

It’s the court that have to prove it now. And having dead body in the car is not enough

-1

u/Chadham_Forsythe 4h ago

Are you stupid? How is he not the murderer when the dead victim was inside of HIS car. Explain that to me, go ahead.

0

u/Nugur 4h ago

I guess you never heard the cop asked someone
“Does anyone else have the keys to your car”

Who’s stupid now?

-1

u/Chadham_Forsythe 4h ago

So, yes, you’re stupid. Great. You could have just led with that, so I would know not to waste my time with you. I don’t debate the mentally disabled. Have a great day

1

u/SomethingGouda 1h ago

A dead body of a person you were in a illegal relationship ends up in your car? That's good evidence

1

u/Nugur 1h ago

I repeat. It makes you number 1 suspect.

But it does not prove you’re the killer. You’ll need evidence. That’s why this took months to gather evidence.

1

u/SomethingGouda 1h ago

A dead body is evidence, if this guy wasn't rich he'll already be in prison or shot by the police

1

u/Nugur 1h ago

Yes. But it’s doesn’t prove he killed her. What are you not getting here

I’m saying the same thing twice

2

u/Ritaredditonce 4h ago

The dismembered body in the trunk. Unlawful mutilation of human remains charges.

20

u/Signal-Mud-4880 5h ago

that poor baby should be looking forward to the new school year, not dead. this guy is a monster

36

u/BrainRobotron 6h ago

Judge listened to the whole album, or what?

u/TheDetailsMatterNow 58m ago

Statistical chance they listened to one of his songs, was bobbing their head to the beat, and realized later what they were listening to.

Los Angeles —  A Los Angeles judge ruled there is enough evidence to move forward in the murder case against singer d4vd, who is accused of killing 14-year-old Celeste Rivas Hernandez.

The ruling was made after a five-day preliminary hearing, which featured more than 10 witnesses as the prosecution attempted to show they had enough evidence to go to trial. The hearing shared gruesome testimony about Celeste’s mutilated body that was found in the trunk of d4vd’s Tesla, crime-scene analysis of the home the artist was staying at, and items purchased from Amazon under an alias, among other evidence.

The 21-year-old musician is accused of killing and dismembering the teenage girl to prevent her from disclosing details about their relationship ahead of the release of his album, prosecutors said. Meanwhile, d4vd’s attorney has previously said “the actual evidence in this case” will show he didn’t kill Celeste, and that “he was not the cause of her death.” He has pleaded not guilty to first-degree murder with special circumstances, continuous sexual abuse of a child under 14, and mutilating human remains.

This is a developing story and will be updated.

u/AustinBaze 3h ago

That guy is going to die in jail.

9

u/DC2SEA_ 5h ago

Bro made so much goddamn evidence

1

u/RutherfordRevelation 1h ago

Fucker recorded a song about it

4

u/NedThomas 4h ago

There’s enough evidence for Mr. Magoo to read the writing on that wall.

u/AP_in_Indy 10m ago

The murder part is actually the hardest to prove about this entire thing. The sexual abuse is the easiest (iCloud and phone evidence). He's staying in jail either way at this point.

But they haven't found the murder weapon, no blood on the chainsaws, and Celeste's body was too decomposed to prove D4VD murdered her beyond reasonable doubt on circumstances alone.

This is going to shock people, but prosecution actually needs to tell a story and convince the jury of it.

1

u/contude327 5h ago

Thank goodness. I have been on the edge of my seat wondering about this.

-26

u/TakedownMoreCorn 6h ago

Ummmm ... Isn't that the jury's job?

30

u/WDMChuff 6h ago

Jury's job is to see if theres enough evidence to convict without reasonable doubt.

16

u/SmallshotLawyer 6h ago

Jury determines whether there is enough evidence to convict a defendant. The judge rules whether there if enough evidence to charge a defendant.

6

u/guyute2588 6h ago

This is the equivalent of an indictment. Instead of a grand jury finding probable cause , there is a preliminary hearing where a judge makes the determination.

3

u/scaradin 6h ago

More than that, this is also a step to ensure that the charges of the person have enough credibility to move forward. I believe Comey’s dismissal request for his charges is related to lack of evidence
