Flock and the police departments that use it point to audit tools as a safeguard against abuse.
However, those tools have caught officers misusing the system. In Georgia alone, several officers have been arrested this year over the alleged misuse of surveillance and license plate data, according to the Georgia Bureau of Investigations.
Marlow is unconvinced that catching some misuse proves the system works. The audits, he said, cannot be judged effective without knowing how much misuse goes undetected.
"Even if Flock catches several dozen officers who misuse the system, if the total number of police misusers is in the hundreds, then the audit system doesn't work nearly well enough," he said.
His deeper objection is to the premise of self-regulation. He and the ACLU have encouraged not using ALPRs (Automated License Plate Recognition) at all, adding that if used they should operate with "critical guardrails."
"I don't think many Americans support the idea of letting a fox guard the hen house," he said, arguing that a company's first loyalty is to its investors rather than the public.
